1. Who we are
MUNAYA ("MUNAYA", "we", "us") designs and sells modal hijabs through this website. MUNAYA is operated by Munaya LLC, a business located in Staten Island, New York, United States. Mailing address: 124 ADA Dr., Staten Island, New York 10314. You can reach us at munaya.modesty@gmail.com.
These Terms and Conditions ("Terms") govern your use of the website and every purchase you make from us. By using the website or placing an order, you agree to these Terms and to our Privacy Policy and Shipping, Returns and Refunds policy, which are part of these Terms.
2. Who can shop here
You must be at least 18 years old to place an order, or use the website with the involvement of a parent or legal guardian. By ordering, you confirm that the information you give us is accurate and that you are authorized to use the payment method provided.
3. Products, colors and descriptions
Our printed designs are created in-house and each listing describes the fabric, size and care of the piece. We photograph and describe every hijab as accurately as we can, but screens differ, so colors and prints may look slightly different in person. That difference alone is not a defect. If something is genuinely wrong with a piece you receive, contact us and we will make it right under our Shipping, Returns and Refunds policy.
Fiber content and care instructions are provided with every product as required by the Federal Trade Commission's Textile Fiber Products Identification Act and Care Labeling Rule.
4. Prices, taxes and payment
All prices are in US dollars. We may change prices at any time, but changes will not affect an order we have already confirmed. Where a price is obviously wrong because of a typographical or system error, we may cancel the order and refund you in full.
Sales tax is collected where New York law requires it. Clothing priced under $110 per item is exempt from New York State sales tax, and in New York City from local sales tax as well; some other New York counties apply a local tax to clothing. Sales tax for other states is collected where the law requires it. Any tax due is shown before you pay.
Payments are processed by Stripe, Inc. We never see or store your full card number. By submitting payment you authorize the charge for the total shown at checkout, including shipping and any tax.
5. Orders and confirmation
Placing an order is an offer to buy. We accept your offer when we send a shipping confirmation. We may refuse or cancel any order, for example when a product is unavailable, when we suspect fraud, or when a pricing or listing error has occurred. If we cancel a paid order, we refund the full amount to your original payment method.
6. Shipping and delivery
Our processing times, shipping methods and delivery estimates are described in our Shipping, Returns and Refunds policy. In line with the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule, if we cannot ship within the time we promised, or within 30 days when no time was stated, we will tell you, and you may cancel for a full refund.
7. Returns and refunds
Returns are accepted within 14 days of delivery on pieces that are unworn, unwashed, unaltered, free of makeup, stains and fragrance, with tags attached and in their original packaging. Because a hijab is worn against the skin and hair, anything showing signs of wear cannot be accepted for hygiene reasons. Sale items discounted 30 percent or more, and gift cards, are final sale. The full conditions, the refund timing and the process are set out in our Shipping, Returns and Refunds policy, which is posted on this website and shown at checkout, as New York General Business Law section 218-a requires.
Nothing in these Terms limits the rights you have under New York law, including General Business Law sections 218-a and 349, or under any other law that cannot be waived.
7a. Risk and title
Title and risk of loss pass to you when the carrier takes possession of your parcel. Where a parcel is lost or damaged in transit we will help you claim against the carrier, and we will replace or refund a parcel that the carrier confirms as lost. We cannot be held responsible for a parcel the carrier has confirmed as delivered to the address you supplied.
7b. Accuracy of your details
You are responsible for the accuracy of the delivery address and contact details you give us. We cannot be responsible for a parcel delivered to an incorrect address supplied by you, and reshipping is charged at the standard rate.
8. Your account, email and messages
When you subscribe to our emails we send you occasional news about new prints, colors and drops. Every email includes an unsubscribe link, and we honor opt-outs promptly, as the CAN-SPAM Act requires. Order emails are sent whenever you place an order, and are not marketing.
9. Our designs and content
Every print, photograph, word and design on this website belongs to MUNAYA or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, print or sell our designs, or use our photographs or name, without written permission. Buying a hijab gives you the physical item, not any rights in the design.
10. Acceptable use
Please do not misuse the website: no attempts to interfere with the site, scrape it, place fraudulent orders, or use it in a way that breaks the law or these Terms. We may block access to anyone who does.
11. Disclaimers and limits on liability
The website and our products are provided as described. To the fullest extent permitted by New York law, we are not liable for indirect, incidental, special or consequential losses arising from your use of the website or products, and our total liability for any order is limited to the amount you paid for that order. Some states do not allow the exclusion of certain warranties or limits on liability, so parts of this section may not apply to you. Nothing here limits liability for death, personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
12. Governing law and disputes
These Terms and any purchase are governed by the laws of the State of New York and applicable federal law, without regard to conflict-of-law rules. If you have a problem, please contact us first at munaya.modesty@gmail.com so we can try to resolve it informally within 30 days. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in the State of New York, and you consent to their jurisdiction. Either of us may bring an eligible claim in small claims court instead.
13. Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they last changed. Orders are governed by the Terms in force when the order was placed.
